HELP!!!! Ex gave child away but is still collecting child support

I hope someone can help me out! My husband has two other children with
two other women, and two orders for child support. The two combined
child support orders total $1,785.50 per month.
Here is the problem:
The woman with the higher child support amount has lost ALL of her
children to the state of VA. One of those children is my husbands
child. My husbands brother and his wife are in the process of adopting
that child, because my husband owes over $30,000.00 for each case, so
he can not make any moves or child support WILL wipe us out and we
will loose EVERYTHING, because even if he were to get the child, there
is another case for child support, and believe me, I have tried
everything I can think of to get the other child away from its mother,
but NOBODY can find ANY dirt on that ex, not even CPS.
Anyway, the adoption is in process now, but child support is still
adding arrears to that case (as well as the other), and the child
doesn't even reside with the mother.

The other ex is a bitch, and just wants money from my husband. When
her son calls I just hang up on him because I don't want my husband
getting suckered into giving that woman ANY money. Last year she sent
us 1/4 of a medical bill to pay. AS IF! We can barely pay our own
bills for the children we have together, so I don't see why that whore
would think she is entitled for one dime toward any bills! If she was
able to pay $2,300, why couldn't she pay the other $766.00 of the
bill? Why the hell is that my husbands problem? We have 4 kids living
with us, and she has one child, so I think our needs are far greater

son because then he would have to deal with the mother. She has two
jobs and takes some classes at a community college, so I would say
they are well off, not to mention she spoils the child and treats him

1.How can we get the child support case which the child no longer

2. How can I get the other child away from the mother? I've called
CPS numerous times but they always come back with there aren't any

No, we have 3 together. I have one from a prev marriage. So what if he
had child support orders before we met? The point is, one of the kids
doesn't even live with its mother, and the other kid's mom want all
our money. I need HELP. I don't know what to do, but I'm not trying to
spend the rest of our lives dodging a bullet. Someone must know how to
atleast get the order closed on the kid that's about to be adopted.

A lot of the answers to your question deals with the timing of any changes
and the amounts involved.

Since there is an arrears you need to get a determination of how much is
owed to the mother and how much is owed to the state. Even though the child
no longer lives with the mother the CS order has continued to accrue
arrears. With the child in foster care that portion of the order accrues to
the state. When the child went into foster care the mother may have had to
sign over all or part of her CS rights to the state. The bottom line is the
arrearages owed will not go away but once the child is adopted the CS order
can be stopped from accruing further amounts due.

On the other order, it must include payment of uninsured medical expenses.
The amount you were asked to pay might be half, or a pro-rata percentage, of
the uninsured amount.

And finally, the courts could care less about the fact you have subsequent
children together. The CS orders for previous children take priority for
the available dollars.

current spouse. The only time they consider other children is when a second
CS order is created. In that case they deduct the amount of the first order
from your husband's income before calculating the second order amount since
he can't pay it out twice. Since your husband has two CS orders it is
likely those orders take over 50% of his disposable income.

Welcome to the realities of CS rules and administration. As stated
previously, the courts could care less about your children and/or your
household. Of course, that approach makes the state's objective of making
child support "for the children" just a bunch of BS.

So what do we do? Do we continue to live below the radar? They can't

Although they technically can't go after your husband's income and assets,
they can issue a bench warrant for his arrest and set the release bond
amount at the total amount of the arrearage. That will put you in the

out.

They will keep trying until the CS is paid. The obligation never goes away.

Be careful about dodging contempt hearing service issues. All the DA's need
to do is tell a judge they have made reasonable attempts to provide legal
service. I have seen a judge who was frustrated about finding a CS obligor
set the release bond at double the amount of the arrearage.

You may want to think about moving elsewhere, like France. There is no end
to the amount of hounding, badgering and out-right harassment that will
befall you and your family when there's a pissed-off "family" court judge
and any kind of an arrears to collect.

Not even Death can (or will) stop collections on C$. The state will go
after anything they can to satisfy this debt. And let's not kid ourselves,
that's exactly what it is, a debt. Unfortunately, as with other debts
accrued throughout one's lifetime, this one will never, ever go away no
matter what you do to it - save pay it off. And that is all but a moot
point when you add-in fees, penalties and incredible amounts in interest
that a state can hit you with. With all that stacking up on a monthly and
yearly basis, it adds up very, very fast.

Even a small amount of arrears can often take another lifetime to pay off.
So no matter what, you'll never be debt-free.

My advice, if you can swing it - move to Mexico, or France, or South Africa,

Screw you! it's wrong. Why should we have to live like criminals while
one ex looses custody of all her kids and the other is a whack job who
thinks her kid is the best thing since sliced bread? Is it right that
we would be homeless if he paid the child support?
The ex that lost her kids (she was married to my husband when we met)
was collecting welfare in one state for her kids while collescting
child support when it came in from the other state. The the other
works two jobs, yet wants more money from MY husband-and they were
never married. What gives her the right to even want a dollar from
him. She didn't even want to have the kid, my husband had to talk her
out of an abortion, and now she acts like the kid walks on water and
does no wrong. She had the nerve to threaten me with violence if I
continued to hang the phone up on her son whe he called for my
husband! I went right to the courthouse to get a restraining order,
and you know what ghey told me???? The judge told me that I could have
a PEACE order because my husband has a child with her and it is not
harrassment for her son to call. It is not harrassment for her to
threaten me either, because the judge said "You are forcing parental
alienation". What the hell is that.

The whore is crazy! She won't date because she "doesn't want to set a
bad example" her child. She won't answer the phone on the fer
occasions my husband has tried to call her because she said "we have
nothing to talk about. Don't call to talk to me, call to talk to our

I went right to the courthouse to get a restraining order,
and you know what ghey told me???? The judge told me that I could have
a PEACE order because my husband has a child with her and it is not
harrassment for her son to call. It is not harrassment for her to
threaten me either, because the judge said "You are forcing parental
alienation". What the hell is that.
The whore is crazy! She won't date because she "doesn't want to set a
bad example" her child. She won't answer the phone on the fer

I think I recall reading in one of your posts that your husband
supports the family. Does that mean that you do not work? If so, it
might be wise for you to get a job. CS can't touch your wages, in
most places anyway. If she is already working 2 jobs and going to
school, expecting her to work more, while you are not working at all
is rather outrageous. I am not a fan of the CS system, but I do think
things need to be fair, and that includes everyone having at least one
job before expecting someone else to have 2 or 3 jobs.

Are the children too young to attend school? Cany you not work part
time when your husband gets home from work, to save on child care
costs? It would be nice if all of us could decide that one parent
would stay home and be the homemaker, and the other would be the
breadwinner, but it does not work that way very often. And your
husband has a far better chance of getting his child support lowered
if the woman gets a better paying job. Why do you object to that? At
least she's not sitting on her butt, expecting her child's father to
do it all. She seems to be trying to be self supporting. You sound

wont be in school for another 4 years.

I went right to the courthouse to get a restraining order,
and you know what ghey told me???? The judge told me that I could have
a PEACE order because my husband has a child with her and it is not

child support orders total $1,785.50 per month.
The woman with the higher child support amount has lost ALL of her
children to the state of VA. One of those children is my husbands

OK, so your story is you married a guy with 2 separate support

I hope someone can help me out! My husband has two other children with
two other women, and two orders for child support. The two combined
child support orders total $1,785.50 per month.
The woman with the higher child support amount has lost ALL of her
children to the state of VA. One of those children is my husbands
child. My husbands brother and his wife are in the process of adopting
that child, because my husband owes over $30,000.00 for each
case,

he can not make any moves or child support WILL wipe us out and we
will loose EVERYTHING, because even if he were to get the child, there
is another case for child support, and believe me, I have tried
everything I can think of to get the other child away from its mother,
but NOBODY can find ANY dirt on that ex, not even CPS.
Anyway, the adoption is in process now, but child support is still
adding arrears to that case (as well as the other), and the child
doesn't even reside with the mother.
The other ex is a bitch, and just wants money from my husband. When
her son calls I just hang up on him because I don't want my husband
getting suckered into giving that woman ANY money. Last year she sent
us 1/4 of a medical bill to pay. AS IF! We can barely pay our own
bills for the children we have together, so I don't see why that whore
would think she is entitled for one dime toward any bills! If she was
able to pay $2,300, why couldn't she pay the other $766.00 of the
bill? Why the hell is that my husbands problem? We have 4 kids living
with us, and she has one child, so I think our needs are far greater
than her and her childs needs. My husband doesn't even want to
see
his
son because then he would have to deal with the mother. She has two
jobs and takes some classes at a community college, so I would say
they are well off, not to mention she spoils the child and treats him
like he's the messiah, or the second comming of christ.
1.How can we get the child support case which the child no longer
lives with the mother dropped?
2. How can I get the other child away from the mother? I've called
CPS numerous times but they always come back with there aren't any
problems in the home. They don't even consider the dog a threat and

A lot of the answers to your question deals with the timing of any changes
and the amounts involved.
Since there is an arrears you need to get a determination of how much is
owed to the mother and how much is owed to the state. Even though the
child
no longer lives with the mother the CS order has continued to accrue
arrears. With the child in foster care that portion of the order accrues
to
the state. When the child went into foster care the mother may have had
to
sign over all or part of her CS rights to the state. The bottom line is
the
arrearages owed will not go away but once the child is adopted the CS order
can be stopped from accruing further amounts due.
On the other order, it must include payment of uninsured medical expenses.
The amount you were asked to pay might be half, or a pro-rata
percentage,
of
the uninsured amount.
And finally, the courts could care less about the fact you have subsequent
children together. The CS orders for previous children take priority for

That's a bit of an arrogant answer, I think. The fact that the older
children were around longer does not make them any more deserving of
being supported, even if family law might say it does. A child is a
child, and no child should be relegated to secondary status!

My husband and I had two children when he found out he had an
almost-13-year-old daughter from a one night stand long before we
met. Why did the discovery of that child relegate our children to
irrelevance? Why did that child receive more per month than we spent
on our 2 children combined? It may be the way the law is written,
but that does not make it right!

more than feeding them? You can send your abandoned family to live on
a farm in El Salvador and 5 people can eat 3 or 4 good meals a day for

you shouldnt have kids if you cant support them. i hope they put that
deadbeat husband of yours goes to jail and maybe you should get
support from your babies father. you should go to jail to for trying
to help the deadbeat get off. i just want to know what makes you think
he is going to support your kids. i think you are seriously crazy. my
daughters father owes me 24,000 in back childsupport and 1167 a month.

I hope someone can help me out! My husband has two other children with
two other women, and two orders for child support. The two combined
child support orders total $1,785.50 per month.
The woman with the higher child support amount has lost ALL of her
children to the state of VA. One of those children is my husbands
child. My husbands brother and his wife are in the process of adopting

omg....you are horrible woman, take a step back. you hang up on the man's son? think about your children and if their dad did this to them? she is giving you 1/4 the bill... it may be hard be her actually owes half. children are a burden a and a blessing and every-time you reproduce it is your resolvability. maybe you should get a second job and take classes a a community college. She sounds like she works her ASS off a full time single mom, working two jobs and ing to school and asking for a little help from our husbands son! I know its hard but step back and do what's right. What you do is not to be compared to what bio parent do. its responsibility equal based on your pay not hers. You made more kids and as you can see from the one you have they are responsibility. It will all work out just believe that, and do what is right.
