Hello,

How to collect past due child support?

There is a court ordered support agreement, he is over five months
without a payment. He has no apparent employer as he works as an
independent contractor.

He has two ex-wives, three kids (1 with #1 and 2 with #2) all of which
live in VA, he lives in MT. Ex wife #1 has not rec'd a payment in
over 10 months.

Talk to me......

If there's an order for support out there somewhere, then they'll eventually
get a piece of his pie, but until then, all you can do is wait. there are
other things that will happen as well as wage garnishments, tax refund
intercepts, for example.

Of course they can always go after his driver's license and force him off
the road.. like that'll help the situation any.

Until (and unless) he surfaces, there ain't a whole lot that you can do.
But if it makes you feel any better, go right ahead and rattle that saber
some more.

What you've got is a guy that's more then likely just found out how screwed
the system is against him. So he's in full on survival mode, honey. If
he's any good at watchin' his own ass, you'll never catch him - unless he
does something really, really stupid.

If I was him, I'd leave the country and never come back. I hear Argentina's
nice this time of year..

Since 1996 mandatory wage withholding has been in Federal law and applies to
all new and modified CS orders. If you don't have wage withholding then
either you have a very old CS order that has never been modified or you
waived your right to wage withholding.

His income can be traced through his SSN or tax ID number. Your state CS
administration can look up his tax records and figure out how to attach his
earnings. If he is not paying his taxes then he has bigger problems than
just not paying CS for a few months.
